Mobbing in the workplace - what it is, how to recognize it and how to legally protect yourself

10 минути

The workplace should be an environment in which the employee can develop professionally, work without fear and preserve his dignity. Unfortunately, mobbing is increasingly common in practice - systematic psychological harassment that leaves serious consequences for the health, self-esteem and livelihood of the worker.

Although many feel that "something is wrong", they often do not know if it is mobbing, which behaviors are prohibited and what exactly they can do. This guide aims to clearly and practically explain what mobbing is and how to protect yourself.

What is mobbing?

Mobbing is any repeated and systematic psychological harassment of an employee at the workplace, which aims or results in an injury to his dignity, reputation, integrity and health.

It is crucial to emphasize that mobbing is not an isolated conflict or a one-time argument, but a continuous behavior that lasts for a long period of time.

Which persons can carry out mobbing?

Mobbing can be carried out by the employer, the superior, but also by colleagues - individually or in groups.

In practice, vertical mobbing (from superior to employee), horizontal mobbing (between colleagues) and reverse mobbing (from employees to superior) is distinguished.

Most common forms of mobbing

Mobbing can manifest itself through various forms, such as constant belittling, insults, ignoring, threats, unjustified shifting of blame or isolation from the work environment.

There are also frequent situations where the employee is deprived of work tasks, assigned humiliating duties or unrealistic deadlines in order to discredit him.

How to recognize that you are a victim of mobbing?

If you experience constant fear, anxiety, loss of self-confidence or work-related health problems, you may be exposed to mobbing.

It is especially alarming when such situations last for a long period of time and are directly related to the behavior of certain persons at the workplace.

Is mobbing prohibited by law?

Yes. Macedonian legislation prohibits mobbing and obliges the employer to provide a safe and dignified working environment.

The employer is obliged to take measures to prevent and protect against mobbing, and failure to do so constitutes a violation of labor rights.

What evidence is important in mobbing cases?

In mobbing proceedings, written evidence, electronic communication, testimonies from colleagues and medical documentation are of particular importance.

That is why it is important to promptly document any behavior that indicates mobbing.

How can the worker protect himself?

The first step is a written notification to the employer and a request to take measures. If this does not yield results, the employee has the right to turn to the State Labor Inspectorate.

In addition, court proceedings for protection against mobbing and compensation for damages are also possible.

Mobbing is not "part of the work culture" and must not be tolerated. Every worker has the right to dignified treatment and a safe working environment.

If you recognize elements of mobbing, timely reaction and legal support are crucial for effective protection of your rights.
