Buying real estate as a foreigner in Macedonia – legal rules and procedure

Buying real estate in North Macedonia is becoming increasingly interesting for foreign nationals. The reasons vary – real estate investment, relocation, purchasing a vacation apartment, or starting a business. The real estate market in the country offers relatively affordable prices compared to many European countries, which further increases the interest of foreign buyers.

However, buying property as a foreigner is not identical to the procedure for domestic citizens. There are certain legal rules, restrictions, and conditions that need to be considered before proceeding with a purchase.

Below is an overview of the most important legal aspects that every foreigner should know before buying real estate in Macedonia.

Can foreigners buy real estate in Macedonia?

According to the Law on Ownership and Other Real Rights, foreign natural and legal persons can acquire ownership in Macedonia, but under certain conditions.

The basic rule is that foreign persons can acquire ownership rights unless otherwise determined by law or international agreement. The law distinguishes between:

  • Foreigners from EU member states
  • Foreigners from OECD member states
  • Foreigners from other countries

In many cases, the principle of reciprocity applies, which means that the rights depend on whether the buyer's home country allows similar rights to Macedonian citizens.

For this reason, before purchasing property, it is often necessary to verify whether reciprocity exists, which is determined by the Ministry of Justice.

What types of property can foreigners buy?

Apartments, houses and commercial premises

Foreign natural persons from EU and OECD member countries can buy apartments, residential buildings, and commercial premises under the same conditions as domestic citizens.

For foreigners from countries that are not EU or OECD members, purchasing is possible but subject to the condition of reciprocity. This means that if the buyer's home country allows Macedonian citizens to buy property there, then foreigners from that country can also buy property in Macedonia.

Construction land

Foreigners can also acquire ownership or long-term lease of construction land, again under the same conditions as domestic persons or subject to the condition of reciprocity. This is particularly important for foreign investors who want to build facilities or develop business projects.

Agricultural land

There is a clear legal restriction here. Foreign natural and legal persons cannot acquire ownership of agricultural land in Macedonia. However, they can obtain a long-term lease, but only with the consent of the Ministry of Justice, following a prior opinion from the Ministry of Agriculture and the Ministry of Finance.

What does the property purchase procedure look like?

The procedure for purchasing property by a foreigner is similar to that for domestic buyers, but with additional administrative checks. The basic steps are:

1. Property verification

The first step is a legal verification of the property, usually carried out by a lawyer or notary. It is necessary to determine whether the seller is the true owner, whether the property has a mortgage, and whether there are other restrictions or disputes. This is verified through a title deed from the Real Estate Cadastre.

2. Signing the purchase agreement

The purchase agreement must be in written form and notarized. The notary verifies the legal validity of the contract and the identity of the parties. In certain cases, additional approval from the competent institutions may also be required.

3. Payment of real estate transfer tax

When purchasing property, a real estate transfer tax is paid, which usually amounts to approximately 3% of the property value (depending on the municipality). This tax is most often paid by the buyer.

4. Registration in the Cadastre

After signing the agreement, an application for registration of ownership is submitted to the Real Estate Cadastre Agency. After the registration is completed, the cadastre forwards the data to the Ministry of Finance and the Ministry of Transport and Communications for record-keeping. With the registration in the cadastre, the buyer officially becomes the owner of the property.

Restrictions and special cases

Although the legislation allows foreigners to buy property, there are certain restrictions. For example, a foreign person cannot own property that has been declared an area of special importance for the security of the state. This may apply to certain border or strategic areas.

Also, if the acquisition of property requires consent from the Ministry of Justice, the legal act (contract) has no legal effect without that consent. Therefore, it is important that the entire procedure is conducted carefully and with appropriate legal support.

Buying property in a foreign country always carries certain legal risks. A lawyer with experience in real estate can help with:

  • Checking the legal status of the property
  • Preparing or reviewing the contract
  • Verifying reciprocity

Buying real estate in North Macedonia is possible for foreign nationals and in many cases the procedure is relatively straightforward. Foreigners can buy apartments, houses, commercial premises, and construction land, while ownership of agricultural land is restricted.

However, there are specific legal rules such as the principle of reciprocity, possible administrative approvals, and the need for proper registration in the cadastre. Therefore, every foreigner considering buying property in Macedonia should carefully review the legal framework and consult with a professional before making a final decision.
